TERMS AND CONDITIONS OF SALE

PURPOSE AND GENERAL INFORMATION

These General Conditions of Use and Sale (hereinafter, the “Conditions of Use and Sale”) regulate the access, purchase, and shipping of the products offered in the online store www.imostickers.com (hereinafter, the Online Store), owned by Alfa Marine Safety S.L., a Spanish company, with registered office at Edif. Arttysur 6ª planta, oficina 3 Pol. Industrial Las Marismas de Palmones, 11379 Puerto de Algeciras, registered in the Mercantile Registry of Cádiz, in Volume 2222, Folio 114, Sheet No. CA 50807, with CIF number B72324320.

It is understood that the user’s access, purchase of products, or mere use of the Online Store implies full and unreserved acceptance of each and every one of the Terms of Use and Sale published by Alfa Marine Safety S.L. at any time the user accesses the Online Store. By accepting these Terms of Use and Sale, the user consents to become a user of Alfa Marine Safety S.L. and their data will become part of the company’s files. These files will be processed in accordance with the provisions of the Privacy and Cookies Policy.

Each order placed in the Online Store is governed by the general terms and conditions applicable at the time of the order.

All users accessing the Online Store must be over 16 years of age with sufficient legal capacity to enter into contracts.

Alfa Marine Safety S.L. operates through the Online Store exclusively for the Spanish territory, including the Iberian Peninsula, the Balearic Islands, and the Canary Islands (hereinafter, the “Territory”). Alfa Marine Safety S.L. only ships and distributes the Products within the Territory.

PRODUCTS AND SERVICES

The descriptions of the Products and Services (as defined below) offered in the Online Store are based on the information and documentation provided by Alfa Marine Safety S.L.’s suppliers and partners.
The photographs, graphic or iconographic representations, and videos related to the Products and Services, as well as trade names, trademarks, or distinctive signs of any kind contained in the Online Store, are intended to provide the user with as much information as possible.

In the event of temporary unavailability of the product, Alfa Marine Safety S.L. reserves the right to provide the customer with information by email about replacement products of equal or greater quality and value. If the customer does not wish to order these replacement products, the full amount of the order will be refunded, and in the event of partial cancellation, only the price of the unavailable Products or Services will be refunded.

In the case of payment by PayPal, the amounts paid will be credited within thirty days, either to the PayPal account that enabled the purchase or refunded to the Buyer’s bank card.

ORDER FORMALIZATION

The User’s purchase of Products through the Online Store will be carried out following the procedure established in the “Order Form/Checkout” section or whatever name has been given to that section on the Website.

The information contained in these Terms of Use and Sale and the details contained in the Online Store do not constitute an offer to sell, but rather an invitation to enter into a contract. No contract will exist between the user and Alfa Marine Safety S.L. regarding any product until their order has been expressly accepted by Alfa Marine Safety S.L. If their offer is not accepted and their account has already been charged, the amount will be fully refunded.

The Contract will only cover those products listed in the order and shipping confirmation. Alfa Marine Safety S.L. will not be obligated to supply any product that may have been ordered until its shipment is confirmed in an order confirmation. Placing an order implies acceptance of these Terms of Use and Sale, as well as the prices of the products and items available for sale in the Online Store.

To place an order, the buyer may:

• either register in the Online Store by filling out the corresponding data form, which will allow them, on the one hand, to place subsequent orders without having to fill out the forms prior to placing the order again and, on the other hand, track all their orders.
• or make one or more purchases in the Online Store without registering. In all cases, the buyer must complete a form, which will collect the necessary data for the order to be registered and sent, and accept the Privacy Policy and the Terms of Use and Sale of the online store.

The order will be processed in several stages: User identification, Invoice and shipping information, Shipping type and payment method, Order confirmation, and order shipment.

To place an order, the user must follow the procedure described above and click “Accept” for payment. Once payment has been authorized, the buyer will receive an email acknowledging receipt of their order (the “Order Confirmation”). All orders are subject to acceptance by Alfa Marine Safety S.L., of which the user will be notified via an “Order Confirmation” email. The contract for the purchase of a product between the user and Alfa Marine Safety S.L. will be formalized only when the Order Confirmation is sent.

At any time, the user who has placed an order can obtain information about the tracking of their order in the Online Store, in the “Check your order” section, by logging in with their email address and password, if they are a registered user, or by entering their email address and order number in the boxes provided.

Alfa Marine Safety S.L. reserves the right to withdraw any product from the Online Store at any time and to remove or modify any material or content therein. Alfa Marine Safety S.L. reserves the right to refuse to process any order after sending the Order Confirmation, at its sole discretion. Alfa Marine Safety S.L. is not liable to the user or any third party for withdrawing any product from the Online Store, regardless of whether said product has been sold or not, removing or modifying any material or content from the Online Store, or refusing to process an order once the Order Confirmation has been sent.

PRICES

The prices of the Products offered through the Online Store do not include VAT and any other applicable taxes. However, these prices do not include the shipping costs of the Products. These are detailed in the payment process and must be accepted by the User at the time of placing the order.

Information regarding price comparisons and discounts applied to the Products listed in the Online Store during the purchasing process is calculated using information provided by Alfa Marine Safety S.L.’s suppliers.

Alfa Marine Safety S.L. reserves the right to change its prices at any time. Products will be billed at the price in effect at the time of order registration.

PAYMENT FOR PRODUCTS

Payment for the price and shipping costs of Products purchased through the Online Store will be made prior to Alfa Marine Safety S.L. sending an email acknowledging receipt and confirmation of the purchase to the User (Order Confirmation).

The proof of purchase or invoice corresponding to the Product order will be available and viewable in the “My Account: Orders” section. From this section, the User can also download the invoice for the order, which will also be sent by email along with the Order Confirmation.

The User must make payment with Visa, Visa Electron, Mastercard, American Express, Euro 6000 cards, or through PayPal. When confirming the order, the buyer must provide their bank payment card number, followed by the type of card (among those accepted in the Online Store), its expiration date, and the three-digit cryptogram on the back of the card. The bank card will be charged within two days of order confirmation. This validation constitutes the express signature and acceptance of all transactions made in the Online Store. The card number provided by the Buyer and the validation of the purchase will serve as proof of the integrity of the order and the enforceability of the amounts due in the execution of said order. The Online Store server is encrypted, and all transmitted data is encoded to prevent fraud. The bank details provided by the User are confidential and transmitted in a secure environment (SSL protocol). Bank card details are not stored on the Online Store’s servers but on those of a bank. Credit cards are subject to verification and authorization by the issuing entity. However, if the entity does not authorize payment, we will not be liable for any delay or non-delivery and we will not be able to enter into any Contract.
Users wishing to make payment through their PayPal account must enter their email address linked to their PayPal account and their PayPal password when validating the order. PayPal encrypts all data provided by the User when creating their account. Thus, no data other than the User’s email address will be communicated to Alfa Marine Safety S.L. Financial and personal data will be automatically encrypted during the transmission of all sensitive information to PayPal servers.

Alfa Marine Safety S.L. will remain the owner of the product until full payment has been made. Alfa Marine Safety S.L. reserves the right to refuse delivery or confirm the order of a User who has not fully or partially paid for a previous order or with whom there is an ongoing dispute.

The User must notify Alfa Marine Safety S.L. of any improper or fraudulent charges on the card used for purchases in the Online Store as soon as possible, so that Alfa Marine Safety S.L. can take the appropriate steps.

ORDER DELIVERY

When placing the order, the User must indicate the location where they wish to receive their order. Orders are delivered to the address provided by the User when placing the order.

If the User is absent at the time of delivery of the Product to the address provided, the carrier will leave a notice indicating how to proceed to arrange a new delivery. If, after ten (10) calendar days from the date of the notice, the User has not contacted the carrier to arrange a new delivery date, the Products will be returned to Alfa Marine Safety S.L., and the User will be responsible for the shipping and return costs, as well as any associated handling fees.

Alfa Marine Safety S.L. will not be responsible for the delivery of a package to an incorrect address if this error results from the information provided by the User when placing the order.

Without prejudice to the provisions of the second clause regarding the availability of products, and except in cases of force majeure or fortuitous event beyond the control of Alfa Marine Safety S.L., orders will be delivered to the User within the time periods indicated in the corresponding Order Confirmation or, if no delivery date is specified, within 15 days from the date of the Shipping Confirmation.

If, for any reason, Alfa Marine Safety S.L. is unable to meet the delivery deadline, you will be informed of this circumstance and given the option to continue with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid.

LIABILITY OF Alfa Marine Safety S.L.

Alfa Marine Safety S.L. is not responsible for delays in the delivery of orders due to force majeure events, and in particular, total or partial strikes by transport services.

Alfa Marine Safety S.L. is not responsible for any inconvenience or damage related to the use of the Internet that is completely beyond the control of Alfa Marine Safety S.L.

Alfa Marine Safety S.L.’s liability in relation to any product purchased from the Online Store will be strictly limited to the purchase price of said product.

To the extent permitted by applicable law, and without prejudice to any provisions to the contrary in these Terms and Conditions, Alfa Marine Safety S.L. will not accept any liability for product losses, regardless of their origin.

All product descriptions, information, and materials appearing in the Online Store are provided as is and without express or implied warranties. To the extent permitted by law, all warranties are excluded, except those that cannot be lawfully excluded against consumers and users. The provisions of this clause will not affect your statutory rights as a consumer and user, nor your right to withdraw from the Contract.

ORDER CANCELLATION

The User may cancel their order as long as it has not been shipped. If the order has left the warehouses of Edif. Arttysur 6th floor, office 3 Pol. Industrial Las Marismas de Palmones. 11379 Port of Algeciras, the order cannot be cancelled, but a refund may be issued once it has been received.

Once the order has been received, the User may choose to exchange a product without waiting for the return and refund to be processed. If the new order is priced lower than the initial price, the User’s bank card will be credited for the difference between the quantity of the returned products and the quantity of the products and items subject to the new order, less the flat rate for the shipping costs of the new order.

ORDER RETURNS

The User has a maximum period of fifteen (15) days from delivery of the Product to withdraw, in whole or in part, from the purchase of the Product, in accordance with applicable law. After the fifteen (15) day period has expired, Alfa Marine Safety S.L. will not accept returns for withdrawal of Product purchases.

If the User returns the entire order within seven (7) days of delivery, the User will be entitled to a full refund of the order amount and the delivery costs, but not the return shipping costs. If the order is returned after the first seven (7) days, the User will be entitled to a full refund of the order amount, but not the delivery and return shipping costs.

Returned orders must include the purchase invoice, be in perfect condition, and in their original packaging. Used or damaged products, or those without their original packaging, will not be refunded. The User shall not have the right to withdraw in the cases established in the applicable regulations and, in particular, but not limited to, in the following cases:

• Products made according to the User’s specifications or clearly personalized.

The User shall be entitled to a refund of the price, shipping costs, and return transportation costs for defective Products or Products delivered if they do not correspond to the order placed by the User, in accordance with applicable legislation.

WARRANTY ON PURCHASED PRODUCTS

The Products have a legal warranty for lack of conformity that becomes apparent within a period of two (2) years from the date of delivery and in accordance with the provisions of applicable regulations. The User must inform Alfa Marine Safety S.L. of any lack of conformity within two (2) months of becoming aware of it.

The warranty offered corresponds to that established in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users. The duration and how to exercise these warranties are clearly detailed in the Product description sheet.

The warranty does not cover defects caused by negligence, impacts, improper use or manipulation, unsuitable voltage, electrical accidents, installation and/or use not in accordance with the instructions or not carried out by an authorized technical service provider, where applicable, or perishable materials or Products, those subject to wear and tear due to normal use, or consumables. Products modified or repaired by the User or any other person not authorized by the manufacturer or supplier are excluded from the warranty. Regarding IT Products, the warranty does not cover virus removal, software recovery for this reason, or software reinstallation caused by deletion.

Among other cases, the User will not have the right to exercise the Product warranty, and consequently, the warranty will not apply:

1.  if any of the information provided in the Product warranty or on the proof of purchase for the Products is modified, altered, or replaced.
2. if the identification number or the guaranteed Product is manipulated or repaired without the knowledge and authorization of the technical service or the company issuing the warranty.
3. if the proof of purchase for the Products is missing.

To exercise the warranty, it is essential to keep the proof of purchase for the Products.

In the event that the manufacturer grants additional commercial warranties, to exercise them, it will be necessary to keep the corresponding warranty certificate.

The User must follow, at all times, the brand’s information leaflet and instructions for the correct use and installation of the Product, as well as all warranty information.

MODIFICATION OF THE CONDITIONS OF USE AND SALE

Alfa Marine Safety S.L. reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Online Store, as well as the Conditions of Use and Sale and Privacy Policy. Users will always have these Conditions of Use and Sale visible, freely accessible for any queries they may have. Users must carefully read these Conditions of Use and Sale each time they access the Website. In any case, acceptance of the Conditions of Use and Sale, in force at any time, will be a prior and essential step to contracting any Product or Service available through the Online Store. Therefore, any modifications that Alfa Marine Safety S.L. may introduce will not apply if they have not been previously accepted by the User.

COMMUNICATIONS BETWEEN Alfa Marine Safety S.L. AND THE USER

Most communications between Alfa Marine Safety S.L. and the User regarding these Terms of Use and Sale or the purchase of Products and Services through the Online Store will be conducted by email at the following address: info@imostickers.com.

For contractual purposes, the User agrees to use this electronic means of communication and acknowledges that all contracts, notifications, information, and other communications sent by Alfa Marine Safety S.L. electronically comply with the legal requirements of being in writing. This condition will not affect your rights granted by law.

APPLICABLE LAW AND JURISDICTION

These Terms of Use and Sale are governed by Spanish law.

In the event of any dispute or disagreement arising from the purchase of Products and/or Services through the Website and/or these Terms of Use and Sale, and for the resolution of any conflicts, the parties agree to submit, at their sole discretion, and waiving any other jurisdiction to which they may be entitled, to the courts and tribunals of Cádiz.

INTELLECTUAL PROPERTY

Alfa Marine Safety S.L. is the owner or licensee of the intellectual and industrial property rights of the Website and the content available through it. Under no circumstances shall granting Users access to the Website imply a waiver, transfer, license, or assignment of all or part of said rights by Alfa Marine Safety S.L.

PERSONAL DATA

The information or personal data you provide about yourself will be processed in accordance with the provisions of the Privacy Policy. By using this website, you consent to the processing of such information and data and declare that all information or data you provide to us is true and accurate.
